What is Form I-130?

Form I-130 — the Petition for Alien Relative — is filed by a U.S. citizen or Lawful Permanent Resident (Green Card holder) to establish that a qualifying family relationship exists between them and a foreign national. It does not grant a visa or Green Card on its own, but it is the required first step in a family-based immigration process. Once approved, it establishes the petitioner's "priority date" in the USCIS queue.

Who can file: U.S. citizens can petition for a spouse, children (under or over 21), parents, and siblings. Green Card holders can petition for a spouse and unmarried children. Eligibility and wait times depend on the relationship category and the beneficiary's country of birth.

Processing times vary widely. For immediate relatives of U.S. citizens (spouse, minor children, parents), times are typically 5–16 months because no visa quota applies. For preference categories (F1–F4), you must wait for a visa number to become available per the monthly Visa Bulletin — this can add years, depending on relationship category and beneficiary's country of birth. Check current times at uscis.gov/processing-times.

Can I petition for my parents if I'm a naturalized U.S. citizen?

Yes. U.S. citizens (whether born or naturalized) who are at least 21 years old can file an I-130 for their parents. Parents of U.S. citizens are considered "immediate relatives" — meaning no annual visa quota applies and they can usually proceed more quickly once the petition is approved. We prepare I-130 packages for parent petitions regularly.

What happens after the I-130 is approved?

After approval, the process depends on where the beneficiary lives. If they are already in the U.S. lawfully, they may be eligible to file Form I-485 (Adjustment of Status) to get their Green Card without leaving the country.
